ChildFreePhD Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and HappyGoLucky Studios LLC ("HappyGoLucky Studios," "we," "us," or "our") and govern your access to and use of the ChildFreePhD website at childfreephd.com and the ChildFreePhD email newsletter, also referred to as The Child-Free Weekly (together, the "Service").
Please read these Terms carefully. They include an arbitration agreement and a class action waiver (Section 13) that affect how disputes are resolved, and they limit our liability (Sections 11 and 12). By using the Service or subscribing, you agree to these Terms. If you do not agree, please do not use the Service.

2. About the Service
ChildFreePhD is a free email newsletter that shares candid commentary and points of view on child-free life. The website exists mainly to let you subscribe and to share information about the newsletter. The Service does not offer paid memberships, account logins, or purchases.
We may change, pause, or discontinue the Service, the newsletter, or any feature at any time, with or without notice.
3. Eligibility
You must be at least 18 years old to subscribe to or use the Service. By using the Service, you represent that you are 18 or older and able to enter into these Terms.
4. Subscribing and unsubscribing
- Free subscription. The newsletter is free. When you subscribe, we ask only for your email address, and we confirm your subscription through a confirmation email (double opt in).
- Frequency. We send the newsletter and occasional related messages on a schedule we determine, which may change over time.
- Unsubscribing. You can unsubscribe at any time using the link in any email, or by emailing hello@childfreephd.com. See our Privacy Policy for details on how we handle your email address.
5. Acceptable use
You agree not to:
- Use the Service in violation of any law or regulation, or to infringe anyone's rights.
- Subscribe using an email address you are not authorized to use.
- Attempt to reverse engineer, scrape, overload, disrupt, probe, or bypass the security or bot protection of the Service, including Cloudflare Turnstile.
- Use bots, automation, or scripts to access the Service or to submit signups, except as we expressly permit.
- Copy, republish, resell, or commercially exploit the newsletter or its content without our written permission, except as allowed by law.
- Use the Service to transmit malware or to harm, defraud, or mislead others.
We may limit or block access for any suspected violation.
6. Newsletter content
The newsletter shares opinions, commentary, and general information for a general audience. It is provided for informational and entertainment purposes only and is not legal, medical, psychological, therapeutic, financial, or other professional advice. Reading the newsletter does not create any professional or advisory relationship. You are responsible for how you use the content, and you should consult a qualified professional for advice about your specific situation. If you or someone else is in immediate danger, contact your local emergency services.
7. Intellectual property
The Service and its contents, including the newsletter text, graphics, logos, design, the ChildFreePhD name and marks, and any editorial persona associated with the newsletter, are owned by HappyGoLucky Studios or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non exclusive, non transferable, revocable license to read the newsletter and view the website for your own use. We reserve all rights not expressly granted.
8. Third party links, sponsors, and cross promotion
The newsletter and website may include sponsor placements, advertising, links to third party websites, and cross promotion of our other brands, including PushBackIQ and ProjectPinkOwl. We do not control third party sites and are not responsible for their content, products, availability, or practices. A link or sponsorship does not mean we endorse a third party. Your use of a third party site is governed by that party's own terms and policies.
9. Privacy
Our collection and use of information is described in our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our practices, including how we handle your email address.
10. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non infringement. We do not warrant that the Service will be uninterrupted, secure, error free, or free of harmful components, or that the content will be accurate or complete. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, HappyGoLucky Studios and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the Service or the newsletter.
To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed fifty US dollars (US $50).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless HappyGoLucky Studios and its members, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service or your violation of these Terms or any law or third party right.
13. Dispute resolution, arbitration, and class action waiver
Please read this section carefully. It affects your legal rights.
Informal resolution first. Before starting any formal proceeding, you agree to contact us at hello@childfreephd.com and give us 30 days to try to resolve the dispute informally.
Binding arbitration. If we cannot resolve a dispute informally, you and we agree that any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration on an individual basis, rather than in court, except that either party may bring an individual claim in small claims court.
Class action waiver. You and we agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding.
Your right to opt out. You may opt out of this arbitration agreement by emailing hello@childfreephd.com within 30 days of first accepting these Terms, stating your intent to opt out. If you opt out, the governing law and venue in Section 14 apply.
This section does not apply where it is prohibited by law.
14. Governing law and venue
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws rules. Subject to Section 13, any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction. Nothing in this section limits any mandatory consumer protections available to you under the laws of the place where you live.
15. General terms
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service and supersede any prior agreements.
- Changes to these Terms. We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, provide notice through the Service. Your continued use after changes take effect means you accept the revised Terms.
- Severability. If any provision is found unenforceable, the rest of these Terms remain in effect.
- No waiver. Our failure to enforce any provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- No third party beneficiaries. These Terms do not create any third party beneficiary rights.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
